Where is my shocked face! The FBI is fudging the numbers (lowering them) on how many times a law-abiding citizen with a firearm stopped an active shooter.    Using the FBI’s definition of an “active shooter incident,” John Lott found that there were 440 such incidents from 2014 to 2022, and an armed citizen stopped 157 of them.  However, the FBI is reporting there were 302 active shooter incidents during this time and only 14 were stopped by an armed citizen.

Canada issues travel advisory to 2SLGBTQI+ persons traveling to the U.S.  The Canadian government’s concern seems to be that some states have passed laws discriminating against 2SLGBTQI+ persons.  If anyone doesn’t want to travel to the U.S. because they think they may get arrested for breaking laws banning mutilation of children and performing simulated sex acts – like you’d find in a strip club – in front of children, then I prefer they go elsewhere.  Oh, from what I understand the “2S” is for 2 Spirits.

If I was still a college student I would oppose this governmental interference in my ability to get a date:  New College of Florida ‘rebalancing’ heavily female campus.”

When virtue signaling meets reality: “Massachusetts Gov. Maura Healey activates National Guard to assist in emergency shelters housing migrants.”

 

GoodThe 5th Circuit Court of Appeals rules that Cops may be sued in their personal capacity for arresting a person over a joke.

During the “COVID Pandemic” Waylon Bailey posted the following joke to his Facebook page:

“SHARE SHARE SHARE ! ! ! ! JUST IN: RAPIDES PARISH SHERIFFS OFFICE HAVE ISSUED THE ORDER, IF DEPUTIES COME INTO CONTACT WITH ‘THE INFECTED’ SHOOT ON SIGHT….Lord have mercy on us all. #Covid9teen #weneedyoubradpitt.”

The hashtag #weneedyoubradpitt was in reference to World War Z and the post was in reply to another joke on Facebook about the “pandemic” that contained laughing emojis.  Alas, the Rapides Parish Sheriff’s Office wasn’t amused and sent a SWAT team to Bailey’s home with bulletproof vests, drawn weapons, and arrested him for a terroristic threat…all without a warrant.

As Baily was being handcuffed, one of the deputies allegedly stated “…next thing [you] put on Facebook should be not to f*ck with the police.”

The doctrine of “Qualified Immunity” protects state actors from being sued in their individual capacity.  In other words, state officials such as police, elected officials, public school teachers, administrators, etc. cannot be held personally liable unless they break “is clearly established” law.  That’s a high bar, because to be clearly established there must be an opinion issued by the appellate circuit court that has jurisdiction or the Supreme Court addressing that issue.

Bailey filed suite in the federal district court for violation of his 1st and 4th amendment rights.  The held the deputies were protected by qualified immunity and dismissed the case.  The 5th circuit disagreed and remained the case for trial.  I believe this is not only the correct decision but a necessary one.  Until those who abuse their authority are held personally accountable, the abuse will continue.

I support the police; I also support targeted police reform aimed at getting rid of incompetent cops and mandating basic civil liberties training.  Sending a SWAT team to arrest a person over a poor joke is not only incompetent but also in violation of his civil liberties.

 

True, “Nikki Haley calls the Senate the ‘most privileged nursing home in the country’ and tells Mitch McConnell, 81, he should ‘know when it’s time to leave.’”  To be fair Nikki Haley should also know when it’s time to leave the Republican Primaries…
